User Agreement for ExpenseDuck.com

Skyline Consulting Co d/b/a ExpenseDuck.com ("ExpenseDuck," "we," "us")

This User Agreement (the "Agreement") governs your use of the ExpenseDuck website, web application, and mobile application (together, the "Service"). By accessing or using the Service you agree to this Agreement and to our Privacy Policy. If you do not agree, do not use the Service.

1. Changes to this Agreement

We may modify this Agreement from time to time. When we make material changes we will post the updated Agreement at expenseduck.com/terms and update the effective date; we may also notify you by email. New features added to the Service are subject to this Agreement. Your continued use of the Service after changes take effect constitutes your acceptance of the changes. Please review this page periodically.

2. Account terms

You must be 18 years or older and a resident of the United States to use the Service. You must provide your full name, a valid email address, and any other information requested to complete signup. Your use of the Service is also subject to our Acceptable Use Policy, which is part of this Agreement. Your login may be used by only one person; you are responsible for maintaining the security of your account and password, and for all activity that occurs under your account. ExpenseDuck is not liable for loss or damage from your failure to keep your credentials secure.

You may not, in connection with the Service:

  • transmit worms, viruses, or any code of a destructive nature;
  • send unsolicited email (spam) or use the Service for unlawful purposes;
  • violate the Acceptable Use Policy;
  • reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

A breach of these account terms, as determined in our sole discretion, may result in immediate suspension or termination of your account. Verbal, physical, written, or other abuse (including threats of abuse) directed at any ExpenseDuck customer, employee, or officer will result in immediate account termination.

3. Tax estimates — not tax advice, never filed for you

The tax figures ExpenseDuck shows are estimates generated from the information you provide (your income, deductions, filing status, household W-2 income and withholding, and prior-year tax) and published federal tax rules for the applicable year. They are provided for planning and organizational purposes only, are not tax, accounting, legal, or financial advice, and are not a guarantee of the tax you will owe or of avoiding any underpayment penalty. Your actual liability is determined on your filed return and may differ. ExpenseDuck does not prepare or file tax returns. You are responsible for the accuracy of your inputs and for your tax filings. Consult a licensed tax professional regarding your specific circumstances.

ExpenseDuck currently estimates U.S. federal taxes only; it does not estimate state or local taxes. ExpenseDuck is not a tax preparation service and does not provide individualized tax, financial, accounting, or legal advice; nothing in the Service should be construed as such advice.

4. Your responsibility to review your numbers

The Service imports, extracts, categorizes, and estimates data through automated processing (see Section 7). You are solely responsible for reviewing and verifying all imported transactions, extracted receipt data, categorizations, mileage records, and tax estimates before relying on them for any tax, financial, or business purpose, and for maintaining the records and documentation applicable law requires you to keep. ExpenseDuck does not guarantee that any report, export, or estimate will be accepted by the IRS or withstand examination by any tax authority.

5. Bank and financial account connections

To import transactions, you may authorize a connection to your bank or card account through our third-party account aggregator, Teller. ExpenseDuck never sees or stores your banking credentials; the connection is established and maintained by the aggregator under its own terms, which apply to you. Bank data feeds depend on your financial institution and are not guaranteed to be complete, accurate, or uninterrupted. You may disconnect a linked account at any time, and connected data is used only to provide the Service.

6. Mileage and location tracking

If you enable automatic mileage tracking, you consent to the collection of background location data on your device for the purpose of detecting and recording drives. GPS-derived mileage is an estimate and you are responsible for reviewing recorded trips for accuracy. You can disable location access at any time in your device settings; automatic drive detection will be degraded or unavailable while disabled. Location data is used solely to provide mileage features, as described in the Privacy Policy.

7. Receipts, uploaded content, and automated processing

You retain ownership of the content you submit to the Service. You grant ExpenseDuck a limited license to store and process your uploaded content (including receipt photos and forwarded email receipts) solely to provide the Service. You represent that you have the necessary rights to the content you upload. Receipt data extraction, transaction categorization, and tax estimation are performed by automated systems, including AI-based processing; their outputs are best-effort, are not guaranteed, and must be reviewed by you. If you forward email receipts to your ExpenseDuck address, only messages from your verified sender addresses are processed.

8. Invoicing

The Service lets you create, send, and track invoices to your clients. You are solely responsible for the content and accuracy of your invoices and for any tax you are required to collect or remit. ExpenseDuck is not a party to any transaction between you and your clients and does not process invoice payments; your clients pay you directly by means outside the Service.

9. Mobile application

Use of the ExpenseDuck iOS application is also subject to the Apple App Store's applicable terms, including Apple's standard licensed application end-user terms; Apple is a third-party beneficiary of this Agreement with respect to the iOS app and may enforce it. Subscriptions are purchased on the ExpenseDuck website only and are billed by our payment provider, Stripe; the iOS app does not offer in-app purchases, and Apple is not responsible for the Service or your subscription. Push notifications are optional and controlled in your device settings.

10. Fees, billing, trial, and refunds

  • The Service is offered as a single plan at $14.99 per month (plus any applicable taxes), billed in advance on a monthly basis, beginning at the end of your free trial.
  • New accounts receive a 30-day free trial with full access. You will not be charged if you cancel before the trial ends.
  • Payments are processed on the web by our payment provider, Stripe; ExpenseDuck does not store your full card details, and no purchases are made through the iOS app.
  • Fees are non-refundable, including for partial months of service; refunds in other circumstances may be granted at ExpenseDuck's sole discretion.
  • Prices may change with at least 30 days' notice, posted on the website or sent to your account email. ExpenseDuck shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
  • All fees are exclusive of taxes, levies, or duties imposed by taxing authorities; you are responsible for those, except for U.S. taxes on ExpenseDuck's income.

11. Cancellation, termination, and deletion

You are responsible for canceling your subscription via the billing screen in your account settings; an email or phone request is not a cancellation. When you cancel, you will not be charged again, and your access to the Service continues through the end of your current paid billing period (or the end of your trial, if you cancel during the trial).

You may delete your account yourself at any time from within the app. Deletion removes your personal data as described in the Privacy Policy, except records we are required to retain by law. We recommend exporting your data first — export is always available (Section 12).

We reserve the right to suspend or terminate your account and refuse any current or future use of the Service for any reason at any time, including violation of this Agreement.

12. Your data: ownership and export

Your data is yours. You may export your content — transactions, mileage, receipts, invoices, and reports — at any time from within the Service. This right survives cancellation for a reasonable period before account data is deleted, and nothing in this Agreement grants ExpenseDuck ownership of your content.

13. General conditions

The Service is provided on an "as is" and "as available" basis, without any warranty or condition, express, implied, or statutory. ExpenseDuck does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) results obtained from the Service will be accurate or reliable, or (iv) any errors in the Service will be corrected. Technical support is provided to paying account holders by email. You acknowledge that we use third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to run the Service.

In no event shall ExpenseDuck, its affiliates, officers, directors, or employees be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including damages for loss of profits, goodwill, use, data, or other intangible losses — resulting from the use of or inability to use the Service, unauthorized access to or alteration of your data, the conduct of any third party on the Service, tax penalties, interest, deficiencies, adjustments, or disallowances, or any other matter relating to the Service. Our failure to enforce any provision of this Agreement is not a waiver of it. We may assign this Agreement without restriction.

14. Entire agreement and severability

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and ExpenseDuck and supersedes all prior agreements, written or oral. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full effect and the invalid provision will be enforced to the maximum extent permitted by law.

15. Governing law and disputes

This Agreement is governed by the laws of the United States and the State of Colorado. Any dispute arising from this Agreement or the Service shall be subject to the jurisdiction of the courts of Jefferson County, Colorado, as the court of first instance.
